Definition of “cookies”.
Cookies are generally small text files that:
- an electronic platform (especially websites, known as a “publisher”) visited by the user; or
- electronic platforms, different websites or web servers (known as “third parties”) through the publisher;
place and store – directly, in the case of publishers, and indirectly, i.e. through them, in the case of “third parties” – within a terminal device available to the user.
The terminal devices referred to are, for example, a computer, a tablet, a smartphone, or any other device capable of storing information. The information encoded in cookies may include personal data, such as an IP address, username, unique identifier or email address, but may also contain non-personal data, such as language settings or information about the type of device a person is using to browse the site.
The same result may also be achieved through the use of similar tracking technologies based on other online identifiers, web beacons, GIFs, or fingerprinting, i.e. the technique of identifying the device used by the user by collecting all or some of the information related to the specific device configuration used by the data subject. Tracking procedures and technologies such as Client/Device Generated Identifier, Statistical ID, HTML5 Cookie Tracking and Universal Login Tracking are used on mobile devices.
The term ‘Cookies’ as used hereinbelow refers to all of the aforementioned tracking technologies and methods operating on web or mobile platforms.
Various types of cookies can be distinguished according to their characteristics and use:
Technical cookies.
These are cookies that are indispensable for the proper functioning of a website and are used to manage various services related to websites (such as a login or access to reserved functions on the sites). These cookies perform functions, including session tracking, storing information on specific configurations regarding users accessing the server, facilitating the enjoyment of online content, etc. They can, for example, be used to keep track of the items in an online shopping cart or the information used to fill in an electronic form online. Technical cookies can be used, among other things, to allow web pages to load faster, as well as to route information over a network – thus in line with requirements strictly related to typical operation of websites. The duration of said cookies is strictly limited to the working session or they may use a longer dwell time in order to remember the visitor’s choices. The deactivation of strictly necessary cookies may compromise the experience of using and browsing the website.
Profiling cookies.
Profiling cookies are used to trace specific actions or recurring behavioral patterns in the use of the offered functionalities back to specific, identified or identifiable individuals for the purpose of grouping the different profiles within homogeneous, multi-sized clusters; this is aimed in turn to enable the controller to, inter alia, provide increasingly customized services beyond what is strictly necessary for the delivery of the given service and also send targeted advertising messages, i.e. messages that are in line with the preferences expressed by the user in the context of their web-browsing activities. Profiling cookies can, for example, be used to convey behavioural advertising and then measure the effectiveness of the advertising message, i.e. adapting the type and methods of the services rendered to users’ behavior as previously monitored.
Analysis (analytics) and performance cookies.
These are cookies used to collect and analyze traffic and use of a website anonymously. These cookies, while not identifying the user, allow, for example, to detect whether the same user returns to log on at different times. They also make it possible to monitor the system and improve its performance and usability. Deactivating these cookies can be done without any loss of functionality.
